Terms of Service

These terms cover Avafem, Inc. ("Avafem", "we", "our") and the website + apps at avafem.com. Using the service means you accept these terms. If you don't agree, please don't use the site.

1. Who can use Avafem

You must be 13 or older to create an account. The Puberty life-stage path is gated behind verified parental consent for users under 18. You're responsible for keeping your login credentials private; please tell us immediately at security@avafem.com if you suspect unauthorised access.

2. The marketplace

Avafem aggregates products from independent merchants. The merchant who ships a given product is shown on its product page; that merchant is the seller of record. Returns, refunds, and warranty claims are processed against the merchant's own policies. Avafem facilitates the cart, payment routing (via the Violet gateway), Beauty Bank credits, and customer support escalations.

3. Beauty Bank, loyalty, and credits

• Beauty Bank credits accrue to LAB on order settle. They mature into spendable Vault credits after 30 days (the window covers most merchant return policies).
• Loyalty tiers (Glow / Flow / Luminary) are calculated on trailing-12-month confirmed spend. Tier perks (multipliers, free shipping at Flow+, weekly Vault offers at Luminary) can be revised; we'll give 30 days' notice before any reduction.
• Credits have no cash value, are non-transferable, and expire 24 months after issue. We may freeze credits tied to fraudulent or chargeback-disputed orders.

4. The AI companion + clinical content

Avafem's chat and curated picks are educational, not medical advice. The medical-claims filter blocks cure/treats/heals language across reviews, community, and editorial — but lived-experience text always carries some risk of out-of-context interpretation. Please use clinical judgment, and bring anything you'd act on to a clinician first. The telehealth referral network exists for that hand-off.

5. User-submitted content

• You retain ownership of reviews, community posts, comments, and creator essays you publish.
• You grant Avafem a worldwide, royalty-free, perpetual licence to display, distribute, translate, and surface your contributions on the platform — including in curated shelves and editorial roundups.
• You won't post: medical claims, dosage prescriptions, content advising someone to skip clinical care, illegal content, infringing content, or anyone's personal identifying information.
• Repeat violations get a temporary mute (Community Ban model). Severe violations get account suspension or termination.

6. Subscriptions + auto-ship

Subscribing schedules a recurring restock at the cadence you choose (14 / 30 / 45 / 60 / 90 days). You can pause, skip, or cancel anytime from /account/subscriptions. The 15% subscriber discount applies as a Beauty Bank LAB rebate at order settle, since merchant prices are set by the merchant.

7. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or enumerate the API beyond rate-limited public access.
• Bypass authentication, the safety filter, or admin gates.
• Use the service to harass, dox, or threaten anyone in our community.
• Submit reviews on products you haven't used. We spot-check via order linkage.

8. Termination

You can close your account anytime (see Privacy Policy > Your controls). We can suspend or terminate access for violations of these terms, with notice except in cases of imminent harm. Financial records persist for the period the IRS requires us to keep them.

9. Disclaimers

Avafem is provided "as-is" without warranties of any kind, except those required by law. Wellness content is educational. We don't guarantee results from any product, routine, or telehealth referral. To the maximum extent permitted by law, Avafem's aggregate liability is capped at the greater of (a) $100 or (b) the amount you've paid Avafem in the prior 12 months.

10. Governing law + disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved by binding arbitration in San Francisco, CA, except for small-claims court actions and intellectual-property injunctive relief, which may be brought in any competent court. Class-action waiver applies to the extent permitted by law.

11. Changes

We'll bump the "Last updated" date at the top when these terms change. Material changes get a 30-day in-product banner before they take effect. Continued use of the service after the effective date is acceptance of the new terms.
